A debt collector has threatened to sue me and to list my name on a public posting board, what should I do? – Sarah

Hello, Sara thanks for your question! It is illigal for a debt collector to threaten to sue you without the authority to do so. Often debts are collectred on a commission basis, therefore the collector does not own the debt. The collector cannot sue you on something they do not own.  If a debt collector’s representative threatens to sue you when their management does not have the authority or intention to do so, you may be able to sue the debt coection company and, in some cases, the individual collector.  If you suceed in your case you may be entitled to up to $1000 in cash in aditional to any actual damages you sustained.

If a debt collector has threatened to sue you and you live in Hennepine or Dakota County, Minnesota, contact us today!
